Congreso Internacional Hispano-Luso e Iberoamericano sobre “Sociedad Digital y Derecho Civil”

El presente Congreso Internacional Hispano-Luso e Iberoamericano sobre “Sociedad Digital y Derecho Civil”, pretende ser un foro de discusión sobre lo que significa hoy en día la sociedad digital y su repercusión en el Derecho civil y en otras ramas jurídicas. Es un hecho que la irrupción de las tecnologías que conforman la sociedad digital se está produciendo de manera exponencial, sobre todo por los avances significativos de la ingeniería del hardware y de la ciencia computacional; y muchos hablan ya de tecnologías disruptivas. Es lo que se ha denominado el cambio de modelo o paradigma fundamental. De todos los avances tecnológicos que se están produciendo, son blockchain y la inteligencia artificial los que producen o pueden producir mayor repercusión jurídica y los que suscitan mayor problemática. Pues blockchain revolucionará las formas de las relaciones jurídicas y la inteligencia artificial nace para ser autónoma respecto de la voluntad del hombre. La cuestión es si los sistemas de Derecho, tan arraigados en la Historia, se van a adaptar sobre las bases y fundamentos actuales o, por el contrario, se va a ir adoptando sistemas jurídicos disruptivos, ¿por qué no? En este sentido, el uso de la inteligencia artificial y de blockchain debe acompañarse con el establecimiento de un marco ético y jurídico apropiado, como han reiterado los diferentes documentos, al respecto, publicados por las Instituciones de la Unión Europea. The International Hispano-Portuguese and Ibero-American Congress on “Digital Society and Civil Law” aim to discuss what digital society means today and its repercussions on Civil Law and other legal branches. It is a fact that the irruption of the technologies that make up the digital society is occurring exponentially, above all due to significant advances in hardware engineering and computer science, and many are already talking about disruptive technologies. This is what has been called the fundamental change of model or paradigm. Of all the technological advances that are taking place, blockchain and artificial intelligence produce or can produce the most significant legal impact, and those that cause the most problems. Blockchain will revolutionise the forms of legal relations, and artificial intelligence is born to be autonomous concerning man’s will. Whether the legal systems, so rooted in history, are going to adapt on the current bases and foundations or, on the contrary, adopt disruptive legal systems, why not? In this sense, the use of artificial intelligence and blockchain must be accompanied by establishing an appropriate ethical and legal framework, as reiterated in the various documents published by the European Union institutions on the subject. The debate is open.
